Recent Medical Malpractice Case

$6,500,000 - Recovered for a 37 year old gentlemen for the delay in the diagnosis and treatment of herpetic encephalopathy resulting in severe brain damage.

$1,500,000 - Recovered for a 48 year old husband and father of two for the delay in the diagnosis and treatment of colorectal tumor. By the time the cancer was diagnosed, the patient was Stage IV. The patient subsequently died from metastatic colorectal cancer.

$1,475,000 - Was recovered for a family as a result of the death of their husband/father who drowned in a golf course pond while playing golf one day by himself. The pond in question had been renovated a few years earlier, which included making it deeper and lining the pond with a slick, plastic-type material which made it next to impossible for someone accidentally falling in the pond to safely exit the pond. No one observed the decedent fall into the pond but it was assumed he was either playing a shot near the perimeter of the pond and slipped in or was attempting to retrieve a golf ball from the pond and ended up slipping in. His body was found at the bottom of the pond the following day.

$1,000,000 - Recovered on behalf of a 53 year old single mother of one minor daughter for the delay in the diagnosis and treatment of breast cancer. It was contended that the healthcare providers were negligent in failing to refer the patient for a biopsy of a breast lump notwithstanding a negative mammogram. By the time of diagnosis, approximately two years later, the patient’s stage had gone from a curable stage to an incurable stage.

$750,000 - Was recovered for the family of a 42 year old gentleman who died from metastatic appendiceal mucinous neoplasm. The case was against a pathologist who failed to recognize evidence of the tumor at the time of the patient’s appendectomy, some two and one half years earlier. The patient left behind his wife and two minor daughters.

$750,000 settlement was on behalf of a 75 year old gentleman confined to a wheelchair for last 60 years for post polio syndrome who went to a surgery center for eye surgery. He was unable to do a self transfer onto the OR table because it did not lower sufficiently nor did the center have any patient lift equipment to allow safer transfer from WC to OR table. Three doctors and a nurse attempted to lift the 235lb patient and in the process fractured his tibia. He subsequently tore his left rotator cuff trying to reposition his casted leg rendering him totally dependent for all transfers. We alleged violation of both federal and state laws which require medical facilities to provide full and equal access to medical services which includes policies and accommodative equipment to assist mobility challenged patients. $634,740 - Was awarded in a case against Kaiser arising out the delay in the diagnosis of a brain tumor based on the misread of a CT scan. The patient was seen in the ER complaining of headaches resulting in a CT scan in 2003, which was read as normal. Approximately five years later, the patient again had a CT scan for complaints of seizure-like activity which led to the diagnosis of a low-grade Glioblastoma. The arbitrator found that the CT scan in 2003 had been misread and that the five year delay significantly adversely affected the patient’s prognosis. Although, it could not be proven that the patient would have likely been cured had he been diagnosed and treated in 2003, it was established that his life expectancy had been shortened by approximately five years and that he is no longer able to work and properly care for his two small children.
